DOMAIN OWNERSHIP / TRADEMARK DISPUTE (WIPO - Domain Name Dispute Resolution)

Question of the Week

DOMAIN OWNERSHIP / TRADEMARK DISPUTE (WIPO - Domain Name Dispute Resolution)

Just cause you found it available on "godaddy" and bought it, doesn’t mean you wont loose it. And just cause you have a registered trademark and use the ® doesn’t mean you will be able to claim ownership on every related domain name. Trademark owners need to be vigilant in protecting the use of their mark and domain name owners need to be carefull on how they use their domains.

Representing a domain name registered by a Cypriot company responding to a claim brought by a big German company, advocating for the Respondent, in a recent case we argued that their registered international trademark has exhausted all its rights and has become a descriptive generic name that rather describes a type of material/product instead of holding the privileges deriving from a mere trademark registration.
